The 2021 Wyoming Claims Seminar was held virtually on Friday, February 19, 2021.  The seminar is designed to introduce all levels of insurance claim handlers to various issues in claims handling, with a focus on tips and tools for evaluating claims and identifying potential problems early in the process.  Our agenda this year included various topics such as COVID litigation preview; telemedicine independent medical evaluations; Wyoming claims handling update, navigating regulations and bad faith pitfalls; and balanced billing for the adjustment of motor vehicles or trailer damage claims.

The Secretary of State has adjusted limitations on damages for all claims for relief that accrue on or after January 1, 2020 as follows: 

• For non-economic damages under C.R.S. § 13-21-102.5(3)(a), the adjusted limitation amount is $613,760.00, which may be increased by the Court upon clear and convincing evidence to a maximum of $1,227,530.00.
• For damages under the wrongful death statute, C.R.S. § 13-21-203(1), the adjusted limitation is $571,870.00.
• For damages under the solatium statute, C.R.S. § 13-21-203.5, the adjusted amount is $114,370.00.
• For damages accruing under the dram shop statute, C.R.S. § 44-3-801, the adjusted limitation is $368,260.00.

For claims for relief that accrue on or after January 1, 2008, and before January 1, 2020, the following limitations apply: 

• For non-economic damages under C.R.S. § 13-21-102.5(3)(a), the adjusted limitation amount is $468,010.00, which may be increased by the Court upon clear and convincing evidence to a maximum of $936,030.00.
• For damages under the wrongful death statute, C.R.S. § 13-21-203(1), the adjusted limitation is $436,070.00.
• For damages under the solatium statute, C.R.S. § 13-21-203.5, the adjusted amount is $87,210.00.
• For damages accruing under the dram shop statute, C.R.S. § 44-3-801, the adjusted limitation is $280,810.00.

The 2020 Wyoming Claims Seminar was held on Friday, February 7, 2020 at the DoubleTree by Hilton located in Aurora, Colorado.  The seminar is designed to introduce all levels of insurance claim handlers to various issues in claims handling, with a focus on tips and tools for evaluating claims and identifying potential problems early in the process.  Our agenda this year included various topics such as biomechanics in low speed motor vehicle collisions, electrical failures of the future, landowners dilemma: gun rights and premises liability in Wyoming, rise of micromobility and implications for transportation-related accidents, Wyoming case law update and consumer complaints.
