Grant Curry recently obtained summary judgment for White and Steele’s client, a component parts manufacturer, by successfully arguing that the claims were barred by the statute of limitations.  Plaintiff claimed that he was injured when he fell from a tank battery stairway severely injuring his back and incurring over $4,000,000.00 in damages.  Plaintiff initially filed a lawsuit naming the manufacturer of the stairway as the only defendant.  Plaintiff later filed an Amended Complaint claiming that our client designed the stairway and that the design was defective.  We argued that the statute of limitations prevented the plaintiff from doing so.  The Wyoming Federal Court agreed that the Amended Complaint was untimely and did not “relate back” to the original Complaint, that the statute of limitations was not tolled, and the case against our client was dismissed.

Grant Curry recently obtained a defense verdict in a jury trial held in Weld County, Colorado.  White and Steele’s client in the case was a locating company accused of failing to properly locate and mark an underground natural gas pipeline resulting in the plaintiff striking the pipeline with his trencher causing a large gas explosion and fire.  Following a four-day trial, the jury returned a defense verdict holding that the locating company exercised reasonable care in locating and marking the underground natural gas pipeline.

Grant Curry obtained a defense verdict in a recent lawsuit where the plaintiff alleged her vehicle had various mechanical issues following services performed by the insured.  The plaintiff claimed that the insured was negligent and breached various warranties owed to her.  The defense argued that the mechanical issues were unrelated to the work it performed on the vehicle and that the plaintiff was unable to prove causation.  The Court returned a verdict for the defense and found the insured was not negligent and did not breach any warranties that were owed to the plaintiff.

Grant Curry obtained a defense verdict for the Board of Directors of a condominium association. The case involved alleged breach of fiduciary duty and negligence on behalf of the defendant Board of Directors for allegedly violating the Declaration and Bylaws with regard to failure to properly repair the complex and replace the roof. The defense was able to show that the Board complied with the Declarations and Bylaws to the best of their ability and t he Court returned a defense verdict in favor of the Board of Directors.

Grant Curry obtained a defense verdict in Adams County District Court arising out of a two car collision on Interstate 25. The jury found that that defendant was not negligent in causing the accident and instead found that the plaintiff’s actions were negligent and the sole cause of the collision.

Monty Barnett and Grant Curry recently obtained summary judgment in defending a plumbing and heating company against claims of carbon monoxide exposure for negligent installation of a HVAC system and gas furnace. The Court granted summary judgment on the basis that Plaintiffs failed to file within the requisite ten year statute of repose as set forth in W.S. § 1-3-111 (2013).
