Jury Trial Victory

March 2024

Keith Olivera’s client received a favorable jury verdict in trial in March.  Plaintiff, a tenant renting a room in Defendant’s home, injured his foot on some landscape edging.  Defendant admitted that Plaintiff injured his foot on Defendant’s property.  Plaintiff walked by the edging at least 30 times and likely many more times.  Plaintiff incurred over $50,000 in medical expenses.  Defendant denied she was responsible under Colorado’s premises liability act and asserted the defense of Plaintiff’s comparative negligence.  Defendant also disputed the amount of Plaintiff’s medical expenses and the nature and extent of his claimed injuries.  Plaintiff’s last demand was $75,000 and the last settlement offer was $50,000.  The jury deliberated for 2.5 hours.  The jury found Plaintiff 49% negligent.  The net verdict for the plaintiff was just under $15,000.
